metadata.teses.dc.description.resumo: Pano de fundo da presente pesquisa, a luta pelo reconhecimento da população LGBT+ perante a sociedade e o ordenamento jurídico brasileiro é assunto latente que enfrenta obstáculos de diversas expressões, não obstante a ordem constitucional, instaurada com a Constituição Federal de 1988, postular vasta principiologia que assegura o tratamento igualitário e digno a todos/as os/as cidadãos/as brasileiros/as. Entretanto, apesar das experiências de desrespeito vivenciadas cotidianamente por brasileiros/as LGBT+ são inegáveis os avanços verificados na resposta estatal às pautas apresentadas pelos movimentos sociais organizados. Assim, levando em conta a história do Movimento LGBT+ no Brasil e considerando o significativo papel que o Poder Executivo desempenhou, até então, na defesa, efetivação e promoção dos direitos LGBT+, o presente trabalho objetiva correlacionar o arcabouço teórico da Teoria do Reconhecimento de Axel Honneth com o acolhimento estatal de tais pautas, verificando de que maneira o Poder Executivo federal tem contribuído para a implantação de novos parâmetros de autonomia e liberdade dos/as brasileiros/as LGBT+. Aqui se concluirá pela necessidade de se ponderar a tendência estatista verificada no Movimento LGBT+ brasileiro, pontuando-se que, apesar dos avanços verificados, o Direito e o Estado não são os únicos meios e instrumentos para se instituir uma nova cultura de respeito à população LGBT+, sendo necessário superá-los, de forma que a atuação do Movimento LGBT+ não fique restrita à liberdade jurídica, sob pena de não garantir plena liberdade e autonomia às pessoas LGBT+.
metadata.teses.dc.description.abstract: Context of this research, the struggle for the recognition of the LGBT+ population in brazilian society and legal system is a latent issue that faces obstacles of various expressions, despite the fact that the constitutional order, established with the Federal Constitution of 1988, determine an equal and dignified treatment for all brazilian citizens. However, although the experiences of disrespect experienced daily by LGBT + people, the progress made in the state response to the requirements presented by organized social movements is undeniable. Thus, taking into account the history of the LGBT + Movement in Brazil and considering the significant role that the Executive Power has held until then in the defense, effectiveness and promotion of LGBT + rights, this paper correlates the theoretical framework of Axel Honneth's Theory of Recognition with the state host of such guidelin requirements, verifying how the federal Executive Power has contributed to the implementation of new parameters of autonomy and freedom for LGBT + brazilians. It will be concluded by considering the need to balence the statist tendency verified in the Brazilian LGBT + Movement, pointing out that, despite the advances that have been made, the Law and the State are not the only way to establish a new culture of respect for the LGBT+ people, and it is necessary to overcome them, in a way that the operation of the LGBT+ Movement is not restricted to legal freedom, under penalty of not guaranteeing full freedom and autonomy to LGBT + people.
