Abstract: Due to the incidence and recurrence of environmental crimes in Brazil, it was neces-sary to discuss the exercise of criminal and administrative sanctions arising from actions and activi-ties harmful to the environment, provided for in the Environmental Crimes Law. In this way, it analyzed the surveillance and penalty of environmental crimes of different scales and in locations through bibliographic review. Therefore, it concluded that there is inefficiency of administrative and penal accountability for environmental crimes. To suggest effective models for the conservation of the environment, we study the availability and efficiency of the consequences that reinforce actions that are beneficial or neutral to the environment.
