Abstract: The laws are effective means in achieving the plans and programs outlined in the policies of a country. For environmental issues, the legal standards are no exception and serve to guide citizens and organizations regarding the rational use and protection of natural resources, whether by prohibition or direction applied by the respective uses of the same, because every law evolves on behalf of society. The aim of this study is to describe the process of creating laws in order to facilitate to those who militate in the technical environment, a better understanding of how they are made or imposed, making more effective their use in environmental issues. The methodology used is exploratory, ie, it is a review and analysis of existing work and research. As a result of this study highlight that the legislative process as determined by the Constitution of 1988 is the same used for both environmental issues and for other legal common. The Federal level starts with the presentation of the Bill to the House of Representatives that performs all necessary procedures by their approval or rejection. Being approved goes to the Senate for deliberation of the house approved the legislation headed for the President to sanction or veto. The same procedures are performed at state and municipal levels, stressing, however, that these two federal agencies have only one legislative house, the Legislative Assemblies and Municipal Councils, respectively, however the achievement of their legal rules can not supersede federal laws.
