| Resumo: | In Law, legislation and liberty, Friedrich August von Hayek does several criticisms to the planned order implemented by welfare states in the Western World. This paper seeks to analyze these criticisms, in particular the normative criteria underlying them. Its thesis is that Hayek fails in his criticisms because he: 1) commits the naturalistic fallacy; 2) doesn’t differentiate sufficiently the theory of the spontaneous order of the theory of cultural evolution; 3) doesn’t realize that the theory of cultural evolution can be reconciled with the planned order. |
