| Abstract: | The post-iluminism Criminal Law has not yet found its proper foundations. This paper aims to show how every single pre-functionalist attempt to justify contemporary Criminal Law has flaws that can not be overcome. We will deal with both absolute and relative theories, as well as the justifications within the anglo-saxan tradition, that departs from quiet peculiar premisses, but has very similar outcomes with the roman-germanic tradition. |
