Resumo
O progresso científico proporcionou um grande desenvolvimento de técnicas
de reprodução humana assistida. A gestação por substituição é uma delas e é vista
como alternativa para as pessoas que desejam realizar o projeto parental, mas não
podem de forma natural, seja por motivos médicos, por não ter parceiros ou por ter
parceiros do mesmo sexo. Apesar disso, essa prática tem gerado grandes controvérsias
do ponto de vista social, jurídico, moral e ético. O presente artigo tem como objetivo
analisar as diferentes regulamentações da técnica no mundo, com enfoque na situação
legal nos ordenamentos espanhol e português. Com isso, realizamos um estudo sobre
suas implicações, principalmente a consequente internacionalização da prática e os
problemas decorrentes dela, como o reconhecimento da filiação da criança e a
vulnerabilidade da gestante. Por fim, ressaltamos a necessidade de criar uma legislativa
própria referente à técnica em cada país, devido a sua complexidade.

Scientific progress has led to major development on assisted human reproduction techniques. Surrogate motherhood is one of them, and it is seen as an alternative for people who wish to carry out the parental project but can’t do it naturally, for medical reasons, for being single or for having same-sex partners. Despite this, the practice has been generating deep controversies from the social, juridical, moral and ethical point of views. The present article aims to analyze the different regulations of this technique around the world, focusing on the legal situation in the spanish and portuguese legal systems. Thereby, a study is conducted about its implications, mainly about the consequent internationalization of the practice and the problems arising from it, such as the recognition of the child's affiliation and the vulnerability of the pregnant woman. Finally, we emphasize the need to create a proper legislative procedure for the technique in each country, due to its complexity.
